Online Store Terms

All orders are offers to buy and are subject to our acceptance. We may refuse, limit, or cancel any order for reasons including suspected fraud, pricing or inventory errors, shipping restrictions, product unavailability, resale concerns, or violation of these Terms.

You agree to provide accurate billing, payment, contact, and shipping information. You authorize us and our payment processors to charge the payment method you provide for the total order amount, including product price, shipping, handling, taxes, and any other disclosed charges.

If we cancel an order after your payment method has been charged, we will issue a refund to the original payment method unless another refund method is required or agreed.

Shipping, Returns, And Refunds

Shipping is governed by our Shipping Policy. Returns, exchanges, refunds, damaged items, and order issues are governed by our Refund / Returns Policy. Those policies are incorporated into these Terms by reference.

Risk of loss for physical products passes to you when the product is delivered to the shipping address you provide, unless applicable law requires otherwise.

Product Use And Pet Safety

MyDog™ products are intended to be used only as described on the Site, product packaging, manuals, assembly instructions, warnings, and other materials we provide. You are responsible for selecting products appropriate for your pet, using them safely, supervising your pet when appropriate, and regularly inspecting products for wear, damage, loose parts, or unsafe conditions.

The Site does not provide veterinary, medical, behavioral, or professional safety advice. If you have questions about your pet’s health, behavior, size, strength, anxiety, containment needs, or suitability for any product, consult a qualified veterinarian, trainer, or other professional before use.

MyDog™ is not responsible for damage, injury, loss, or expense caused by misuse, improper assembly, failure to follow instructions, lack of supervision, pet behavior, unauthorized modifications, or use of a product for an unintended purpose.

Promotions

Discounts, coupon codes, giveaways, bundles, trials, and other promotions may be subject to separate terms, eligibility rules, expiration dates, exclusions, and limits. We may modify or end promotions at any time unless prohibited by law.

User Content

If you submit reviews, photos, videos, comments, feedback, suggestions, or other content to the Site or to us (“User Content”), you represent that you have the right to submit it and that it does not violate the rights of any other person.

You grant MyDog™ a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, display, publish, distribute, edit, and create derivative works from your User Content in connection with our Site, products, marketing, social media, customer support, and business operations.

You may not submit User Content that is unlawful, misleading, defamatory, obscene, harassing, threatening, abusive, infringing, invasive of privacy, or otherwise harmful. We may remove or refuse User Content at our discretion.

If you send ideas, suggestions, concepts, designs, product improvements, or other feedback to MyDog™, you agree that we may use them without restriction or compensation to you. Limitation Of Liability

To the fullest extent permitted by law, MyDog™ and its owners, officers, employees, contractors, suppliers, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption, arising out of or related to your use of the Site or products purchased through the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site, these Terms, or a product purchased through the Site will not exceed the greater of the amount you paid to MyDog™ for the product or service giving rise to the claim or $100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless MyDog™ and its owners, officers, employees, contractors, suppliers, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your User Content, your violation of these Terms, your violation of any law or third-party right, or your misuse of a product.

Severability

If any part of these Terms is found unenforceable, the unenforceable part will be interpreted to the fullest extent permitted by law, and the remaining provisions will remain in effect.

Changes To The Site Or Terms

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Venue for disputes will be in the state or federal courts located in or serving Lexington, Virginia, unless applicable law requires another forum.
